Cloudbac ("us", "we", or "our", is a part of Jhajharia Infratech Private Limited). We operate https://www.cloudbac.com/ (hereinafter referred to as "Service"). Our Privacy Policy governs your visit to https://www.cloudbac.com/, and explains how we collect, safeguard and disclose information that results from your use of our Service.

We use your data to provide and improve Service. By using Service, you agree to the collection and use of information in accordance with this policy. Unless otherwise defined in this Privacy Policy, the terms used in this Privacy Policy have the same meanings as in our Terms and Conditions.

We will retain your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use your Personal Data to the extent necessary to comply with our legal obligations, resolve disputes, and enforce our legal agreements and policies.

We will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period, except when this data is used to strengthen the security or to improve the functionality of our Service.

We are based in India. Your information, including Personal Data, is processed through trusted service providers, including Cloudflare (hosting and content delivery), Neon (serverless database), and Razorpay (payment processing). Some of these providers may process or store data on infrastructure located outside India.

Where personal data is transferred outside India, we do so in accordance with the Digital Personal Data Protection Act, 2023 — transferring only to countries that are not restricted by the Government of India, and under appropriate safeguards. Your consent to this Privacy Policy, followed by your submission of such information, represents your agreement to that processing.

We may disclose personal information that we collect, or you provide:

• Disclosure for Law Enforcement. Under certain circumstances, we may be required to disclose your Personal Data if required to do so by law or in response to valid requests by public authorities.

To exercise any of these rights, email [email protected]. We act as a Data Fiduciary for the personal data we collect about our own users, and as a Data Processor for client data processed within CloudBac CRM and WhatsApp features on a client's behalf.

Where we rely on your consent, we obtain it through a clear affirmative action and only for the specified purposes described in this policy. You may withdraw your consent at any time through your account settings or by emailing [email protected]. Withdrawing consent will not affect the lawfulness of processing carried out before the withdrawal; following withdrawal, we will stop the relevant processing unless we are permitted or required by law to continue.

In accordance with the Digital Personal Data Protection Act, 2023, the Consumer Protection (E-Commerce) Rules, 2020, and the Information Technology Act, 2000, you may contact our Grievance Officer with any questions or complaints about your personal data at [email protected]. We will acknowledge your complaint within 48 hours of receipt and endeavour to resolve it within one month.

We may employ third party companies and individuals to facilitate our Service ("Service Providers"), provide Service on our behalf, perform Service-related services or assist us in analysing how our Service is used. These third parties have access to your Personal Data only to perform these tasks on our behalf and are obligated not to disclose or use it for any other purpose.

Google Analytics is a web analytics service offered by Google that tracks and reports website traffic. Google uses the data collected to track and monitor the use of our Service. This data is shared with other Google services. Google may use the collected data to contextualise and personalise the ads of its own advertising network.

Cloudflare analytics is a web analytics service operated by Cloudflare Inc.

Cloudbac uses remarketing services to advertise on third party websites to you after you visited our Service. We and our third-party vendors use cookies, only where you have given consent, to inform, optimise and serve ads based on your past visits to our Service. You can withdraw this consent at any time. We do not undertake remarketing directed at children.

We may provide paid products and/or services within Service. In that case, we use third-party services for payment processing. We will not store or collect your payment card details. That information is provided directly to our third-party payment processors whose use of your personal information is governed by their Privacy Policy.

The payment processor we work with is Razorpay.

Our Service may contain links to other sites that are not operated by us. If you click a third party link, you will be directed to that third party's site. We strongly advise you to review the Privacy Policy of every site you visit. We have no control over and assume no responsibility for the content, privacy policies or practices of any third party sites or services.

Our Service is intended for users aged 18 and above. Consistent with the Digital Personal Data Protection Act, 2023, we treat any individual under the age of 18 as a child and do not knowingly process a child's personal data without the verifiable consent of a parent or lawful guardian. We do not undertake tracking, behavioural monitoring, or targeted advertising directed at children. If you become aware that a child has provided us with Personal Data, please contact [email protected] and we will take steps to remove that information from our servers.

When a client uses our WhatsApp features, we obtain certain information from Meta and WhatsApp ("Platform Data") in order to provide the service. This may include the client's WhatsApp Business account and phone number details, message templates, message delivery status, and the messages exchanged between the client and the client's customers.

We process Platform Data only to operate and support the WhatsApp service for the client it belongs to, acting as that client's processor. We do not sell Platform Data and do not use it for our own purposes. We delete Platform Data on the client's request or on termination, subject to legal retention requirements and consistent with Meta's terms. Our handling of Platform Data is also governed by Meta's applicable terms and policies.

We may update our Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page. We will let you know via email and/or a prominent notice on our Service, prior to the change becoming effective.
