Cloudbac ("us", "we", or "our") is part of Jhajharia Infratech Private Limited, operating https://www.cloudbac.com/ (the "Service"). The Privacy Policy governs visits to the site and explains data collection and disclosure practices. By using the Service, you agree to information collection per this policy. Terms and Privacy Policy together constitute your agreement.
By creating an account, you consent to newsletters and promotional materials. You may opt out by following unsubscribe links or emailing the company.

You represent that you have the legal right to use payment methods and that supplied information is accurate. The company employs third-party payment services and reserves the right to refuse or cancel orders for product availability, pricing errors, fraud suspicions, or unauthorized transactions.

Services billed on subscription basis occur on recurring, periodic cycles (monthly or annual). Subscriptions automatically renew unless cancelled through account management or customer support. Valid payment methods are required. Users must provide accurate billing information including name, address, state, zip code, telephone, and payment details. Automatic billing failures result in electronic invoices requiring manual payment by specified deadlines.
The company may offer limited free trials at its discretion. Billing information may be required to sign up. Users won't be charged until the trial expires. On the final day, unless cancelled, applicable subscription fees are automatically charged. The company reserves the right to modify or cancel free trial offers at any time without notice.
The company may modify subscription fees at its discretion. Changes become effective at billing cycle end. Reasonable prior notice is provided to allow cancellation before changes take effect. Continued service use after fee changes constitutes agreement to new amounts.
Digital goods and one-time digital services. Certain offerings are digital goods or bespoke digital services — including but not limited to logo design, website creation and setup, custom design or development work, templates, and other similar digital deliverables ("Digital Deliverables"). Because these are created, customised, and/or delivered specifically for you, all sales of Digital Deliverables are final and are non-refundable, non-returnable, and non-exchangeable once delivery has occurred or once work or provisioning has begun, to the maximum extent permitted by applicable law including the Consumer Protection Act, 2019. You acknowledge and agree to this no-refund condition at the time of purchase.
Subscription services. Recurring subscription services (such as CloudBac Sites, Analytics, and CRM) may be cancelled at any time through your account or by contacting us; cancellation takes effect at the end of the then-current billing cycle. Where a first-purchase refund applies, it must be requested within seven (7) days of the original purchase and will be processed within fifteen (15) working days. Except as stated above or as required by law, fees already paid for the current or past billing cycles are non-refundable, and we do not provide pro-rata refunds for partial billing periods.
Your statutory rights. Nothing in this policy limits any non-excludable rights you may have under the Consumer Protection Act, 2019 or other applicable Indian law.
The Service allows users to post information, text, graphics, videos, and materials. Users are responsible for content legality, reliability, and appropriateness. By posting, you represent you own the content or have rights to use it. Posting must not violate privacy, publicity, copyright, or contract rights of others. The company reserves the right to terminate accounts of copyright infringers.
Users retain rights to submitted content and are responsible for protection. The company assumes no liability for user-posted content but grants itself and other users rights to use, modify, perform, display, reproduce, and distribute posted content. The company may monitor and edit content but has no obligation to do so. Company-owned content on the Service cannot be distributed, modified, transmitted, reused, downloaded, reposted, or copied for commercial or personal gain without express written permission.

Service is intended only for access and use by individuals at least eighteen (18) years old. Users must be 18+ with authority to enter this agreement. Those under 18 are prohibited from accessing or using the Service.
Users creating accounts guarantee they're above 18 and that provided information is accurate, complete, and current. Inaccurate, incomplete, or obsolete information may result in immediate account termination. Users are responsible for maintaining account and password confidentiality and restricting access. Users accept responsibility for all account activities. They must immediately notify the company of security breaches or unauthorized use. The company reserves the right to refuse service, terminate accounts, remove or edit content, or cancel orders at its discretion.
Service and its original content (excluding user-provided Content), features and functionality are and will remain the exclusive property of Cloudbac and its licensors. Service is protected by copyright and trademark law. Trademarks and trade dress cannot be used with products or services without prior written consent.
The company respects intellectual property rights and responds to copyright infringement claims. Copyright owners or their representatives may submit claims via email to [email protected] with subject line "Copyright Infringement" and detailed descriptions.
Users may provide feedback directly to [email protected] or via third-party tools. Users acknowledge they retain no intellectual property rights to feedback; the company may have similar development ideas; feedback contains no confidential information; and the company has no confidentiality obligations.
The Service may contain links to third-party websites or services not owned or controlled by Cloudbac. The company has no control over third-party content, privacy policies, or practices and doesn't warrant their offerings. Users acknowledge Cloudbac is not responsible for damages or losses from third-party content, goods, or services.
CloudBac offers features that connect to the WhatsApp Business Platform. CloudBac acts as a technology provider that helps clients connect their WhatsApp Business accounts and phone numbers to the WhatsApp Business Platform and communicate with their customers through CloudBac CRM.
Each client owns and is responsible for its own WhatsApp Business account. Use of the WhatsApp features is additionally governed by Meta's applicable terms and policies, including the Meta Platform Terms, the WhatsApp Business Messaging Policy, and the WhatsApp Business Commerce Policy. By using these features, the client agrees to those terms and policies.
"Platform Data" means any information CloudBac obtains from Meta or WhatsApp in order to provide the WhatsApp features — for example, WhatsApp Business account and phone number details, message templates, message delivery status, and the messages exchanged between a client and the client's customers.
CloudBac accesses and processes Platform Data solely to provide and support the service for the client it belongs to, acting as that client's processor. CloudBac does not sell Platform Data and does not use it for its own purposes. CloudBac deletes Platform Data upon the client's request or upon termination, subject to legal retention requirements and consistent with Meta's terms.
Clients using the WhatsApp features agree to:
Our Service allows an account holder (including an organisation administrator or agency) to create websites, digital goods, or other digital services for, or on behalf of, their own clients or other third parties ("End Clients"). Where an account holder does so, the account holder — and not CloudBac — is the creator and seller of that digital good or service, and:
These services are provided by company on an "as is" and "as available" basis. The company makes no representations or warranties regarding service operation, information, content, or materials. Users expressly agree their service use is at their sole risk.
Except as prohibited by law, you will hold us and our officers, directors, employees, and agents harmless for any indirect, punitive, special, incidental, or consequential damage. If liability is found, it is limited to amounts paid for products or services.
The company may terminate or suspend accounts and bar Service access immediately, without prior notice or liability, for any reason including Terms breaches. Users may terminate by discontinuing Service use. Provisions that should survive termination — including ownership, warranty disclaimers, indemnity, and liability limitations — remain in effect.
These Terms are governed by and construed in accordance with the laws of India, without regard to conflict-of-law principles. The courts at Jaipur, Rajasthan shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms. The company's failure to enforce terms doesn't constitute waiver. If any provision is held invalid or unenforceable, remaining provisions remain effective. Terms constitute the entire agreement and supersede prior agreements.
In accordance with the Consumer Protection (E-Commerce) Rules, 2020, the Digital Personal Data Protection Act, 2023, and the Information Technology Act, 2000, any complaints or grievances may be directed to our Grievance Officer at [email protected]. We will acknowledge your complaint within 48 hours of receipt and endeavour to resolve it within one month.
